Delicia Membership and Home Delivery Terms & Conditions

1. These Terms

1.1 These terms are the terms and conditions applicable to the delivery membership of delicia.com.hk. Delicia.com.hk been established and is operated by Delicia Hong Kong. If you apply to become, or become, a member of home delivery by delicia.com.hk or use any of the benefits arising from the delivery service, you will be taken as having been bound by these terms, and will be taken to have given the privacy consents referred to in these terms.

1.2 These terms are for the benefit of, and enforceable by, delicia.com.hk. References to "we", "us" and "our" are references to delicia.com.hk who may enforce these terms. An electronic communication from us will satisfy any requirement for a written communication from us. Any electronic communication we send you will be taken to be sent when it first enters an information system outside our control. Where these terms allow you to send communications to us by electronic means, an electronic communication to us will be taken to be received by us at the time it first comes to the attention of our addressee (or where no person is designated by us as our addressee, when it first comes to the attention of our representative who is responsible for receiving such electronic communications).

2. Membership issues

2.1 You can become a member of delicia.com.hk if you are an individual resident in Hong Kong SAR and meet any eligibility criteria set out in these terms and have your membership accepted by delicia.com.hk (acceptance being at delicia.com.hk sole discretion).

2.2 The criteria for membership include completing site registration and/or an enrolment in the form delicia.com.hk requires. For online enrolment, we will send you a confirmation e-mail to confirm that your application for, or grant of, Membership has been processed.

2.3 Where we must give you notice of any matter concerning a delivery order or your membership, we will be taken to have given you that notice if we send you a communication (whether by email, post or otherwise) to the address (including email address) listed for you in our records.

3. General

3.1 This Agreement is governed by and will be construed in accordance with the law in force in the Hong Kong SAR and you agree to submit to the non-exclusive jurisdiction of courts of that SAR.

3.2 If any provision in this Agreement is void or unenforceable, that provision shall be read down to the extent necessary to make it valid and enforceable and, to the extent that it cannot be so read down, shall be deemed to be severed from this Agreement.
